Terms of Service

These Terms of Service (the “Terms”) govern your use of the Aerify mobile application (the “App”) and the aerify.ai website (together, the “Service”). By installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Aerify is a minimalist mindfulness app. It provides a single quote each day and a short breathing visualization. The Service is provided free of charge for personal, non-commercial use. We may add, change, or remove features from time to time.

2. Not medical or mental health advice

The Service is intended for general wellbeing and relaxation. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease or condition. Content delivered through the Service is not a substitute for professional medical, psychological, psychiatric, or other healthcare advice. If you are experiencing a medical or mental health emergency, please contact your local emergency services or a qualified professional. Do not delay seeking professional advice because of something you read or saw in the Service.

3. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by applicable law.
• Use the Service to violate any law or the rights of any other person.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell, sublicense, or commercially exploit the Service or any content within it.

4. Intellectual property

The App, the website, and all content we create for the Service (including the breathing visualization, layout, graphics, and our original written copy) are owned by us and protected by intellectual property laws. Daily quotes are attributed to their authors where authorship is known and used in a manner we believe to be consistent with fair use. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use.

5. Third-party stores

The App is distributed through the Apple App Store and Google Play. Your use of those stores is also subject to their respective terms. If there is a conflict between these Terms and the store’s terms with respect to the download and installation of the App, the store’s terms control for that limited purpose.

6. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

7. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars (US $100).

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service in violation of these Terms or applicable law.

9. Termination

You may stop using the Service at any time by deleting the App. We may suspend or discontinue the Service, or any part of it, at any time, with or without notice.

10. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the “last updated” date above. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
